29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins and/or indications of failure of protective systems: (a) On or about November 13, 2013, for the employees installing wood materials in an unprotected trench approximately five feet, nine inches, deep where one employee was fatally injured from a trench wall cave-in without a trained competent person on-site at or near 13302 57th Street NW, Williston, North Dakota.
