29 CFR 1926.21(b)(2) The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: Location: The St. Charles Boschertown Lift Station, 3400 N. Highway 94, St. Charles, MO 63301. On or about 8/27/12 the general contractor (controlling employer) failed to notify/instruct a subcontractor employee in the recognition and avoidance of unsafe condition(s) observed. On or about 8/28/12 a fatality occurred when a subcontractor employee was assigned to coat pipes in an 18' 6" deep valve vault. OR IN THE ALTERNATIVE: 29 CFR 1926.21(b)(6)(i) Employees required to enter into confined or enclosed spaces were not instructed as to the nature of the hazards involved, the necessary precautions to be taken, and in the use of protective and emergency equipment required. The employer did not comply with specific regulations that applied to work in dangerous or potentially dangerous areas: Location: The St. Charles Boschertown Lift Station, 3400 N.
