29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103) The employer does not ensure that a medical evaluation to determine the employees ability to use a respirator is provided before the employee is fit tested or required to use the respirator in the workplace. This violation occurred on or about April 28, 2012, at a residential home under construction where a medical evaluation was not provided for employees required to wear a 3M full face respirator with high efficiency (HE) filters and a Bullard free air pump when spraying foam insulation, exposing employees to inhalation hazards.
