Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the potential hazard of being struck by a suspended load: a/ At the yard, periodic inspections of the five-point grapple attached to the Fuchs MHL331 Terex Wheeled Material Handler were not performed. One method of abatement to correct this apparent hazard is to perform thorough periodic inspections of these mechanical lifting devices as required by ASME B30.20-2003, paragraph 20-1-3.4.
