Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: being crushed by the roll-over protective structure on this machine due to operator's failure to wear the provided seat belt: (a)Opposite 152 Old Jackson Road, north of Gluckstadt, Mississippi - On or about March 28, 2007, an employee was observed operating a John Deere 700 J LGP Crawler Dozer while not wearing a seat belt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that seat belts are always worn anytime a machine, equipped with a Roll-Over Protective Structure, is operated.
