Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: falling from and being crushed by an asphalt compactor/roller with steel rollers due to the employee's failure to wear a seatbelt. (a)Northside Drive at Cascades Circle West workzone, Clinton, Mississippi - On or about September 8, 2006, the Mississippi Paving & Construction, Inc. employee operating the steel wheeled Ingersoll-Rand DD-110 asphalt compactor/roller was not wearing the seatbelt provided on the machine. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require that equipment operators always wear the seatbelt provided.
