Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and crushing hazards while riding the elevator platform which was not enclosed on the sides and top: a)Job Site: The elevator platform on which employees were riding was not enclosed on the sides and top, thus exposing the employees to crushing & fall hazards, on or about 07/12/05. Among other methods, one feasible means of abatement is to fully enclose the elevator platform on all nonentrance sides and the top, as outlined in the Safety Code for Existing Elevators and Escalators, ASME A17.3-1996 section 3.4.1 NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
