North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Ref: American National Standard (ANSI) Z245.1-1992 section 6.2.4 a) a)hit by on coming traffic or backed over / employees were allowed to ride the rear steps of rear loading refuse trucks in excess of 2/10 of a mile, while the truck is backing up and more then 10 mph. Employees had not received instructions and training in safe methods of work before being assigned to operate, clean, service, maintain, or repair the equipment. The employer did not maintain records of the names of employees that had been trained. Among other methods, one feasible and acceptable abatement method to correct the hazard is to provide training under 1910.147 (c), the manufacturers and American National Standards recommendations.
