29 CFR 1910.134(c)(2)(ii):The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: On or about September 22, 2025 - SL Green Realty Corp located at 919 3rd Ave, New York, NY 10022 a) Employees were provided with respirators such as but not limited to 3M elastomeric half -face respirators for voluntary use without receiving medical evaluation to determine respirator use. The employer did not ensure that employees voluntarily using tight-fitting respirators were medically able to use the respirator. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
