29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: On or about August 1, 2025, and at times prior, on a site located at 4529 Hypoluxo Road, Lake Worth, Florida, the employer required employees to wear a full-face respirator when entering an underground fuel tank when exposed to respiratory hazards such as, but not limited to, Benzene, Toluene and Merican 9505 Unsaturated Isophthalic Resin while entering an underground fuel tank to conduct repairs, without providing a medical evaluation prior to use.
