29 CFR 1910.178(m)(7): Truck operations. Brakes shall be set and wheel blocks shall be in place to prevent movement of trucks, trailers, or railroad cars while loading or unloading. Fixed jacks may be necessary to support a semitrailer during loading or unloading when the trailer is not coupled to a tractor. The flooring of trucks, trailers, and railroad cars shall be checked for breaks and weakness before they are driven onto. On or about March 12, 2025, at an establishment located at 2430 East Glendale Avenue in Appleton, Wisconsin, Plant 1 - Loading Dock #4; the employer did not ensure that brakes were set and wheel blocks were in place to prevent the movement of a truck (Wisconsin tractor plate MS 5864) and semi-trailer (VIN: 1JJV532D7F828313) while a forklift operator was attempting to load palleted materials into the trailer utilizing a Linde electric forklift (Model: E20, Serial: A1X346J00231/2018), exposing the forklift operator to crushed-by, caught in-between, and fall hazards.
