29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace: a. At 4590 Atlantic Avenue, Daytona Beach, Florida: On or about January 29, 2025 and times prior, the employer exposed employees to respiratory hazards, in that the employer required the use of 3M Brand, N95 filtering facepiece dustmask respirators to be worn while sanding walkways without first providing a medical evaluation to determine if employees were able to wear a respirator or not.
