29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. a) On or about November 25, 2024, at a worksite located at 1113 V Street NW, Washington, DC, the employer did not have a competent person on site who can recognize hazards associated with trenching/excavations and the means to abate hazards such as methods of protecting employees while working near vertical walls, soil classification, and means to exit or enter the work area safely. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
