29 CFR 1910.145(f)(3): Tags were not used as a means to prevent accidental injury or illness to employees who are exposed to hazardous or potentially hazardous conditions, equipment or operations which are out of the ordinary, unexpected or not readily apparent. a) 3010 Rhode Islande Ave, NE Washington, D.C. 20018, tire storage racks: On or about November 27, 2024, the employer did not implement the use of tags to warn employees of potential fall hazards associated with accessing the third level of the tire rack. The failure to warn employees of potential fall hazards attributed to an employee fatality. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
