29 CFR 1910.133(a)(1): Protective face equipment was not required where there was a reasonable probability of injury that could be prevented by such equipment: (a)Berry Global, Inc. at 1800 North M Avenue, Sioux Falls, SD 57104: On or about and at times prior to October 22, 2024, the employer did not require employees opening the swing gate of the Agglomeration Catcher on the 801 Reprocessing Line to use appropriate face protection to prevent burn injuries when exposed to hot slurry exiting through the Agglomeration Catcher swing gate. This condition exposed employees to burn hazards.
