29 CFR 1910.95(j)(1): The employer did not evaluate hearing protector attenuation for the specific noise environments in which the protector will be used and use one of the evaluation methods described in Appendix B: Methods for Estimating the Adequacy of Hearing Protection Attenuation: (a) On or about October 17, 2024 - Facility, Abrasive blasting area, an abrasive blaster was exposed to intermittent noise at approximately 9999% of the allowable 8-hour time-weighted average (85 dBA). The equivalent dBA of the employee was approximately 123 dBA. The sampling was performed for 430 minutes during one shift on January 15, 2025. Zero exposure was assumed for the unsampled time of 50 minutes. The employer did not provide adequate hearing protection devices, based on the noise environment, to reduce employee exposure. (b) On or about October 17, 2024 - Facility, Abrasive blasting area, an abrasive blaster was exposed to intermittent noise at approximately 7026% of the allowable 8-hour time-weighted average (85 dBA). The equivalent dBA of the employee was approximately 120.7 dBA. The sampling was performed for 464 minutes during one shift on January 15, 2025. Zero exposure was assumed for the unsampled time of 16 minutes. The employer did not provide adequate hearing protection devices, based on the noise environment, to reduce employee exposure.
