29 CFR 1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a.) On or about May 9, 2024, at or near the Northeast intersection of School St. and Rebecca Ave. Hubbard OH, 44425 a competent person was on site and did not identify hazards associated with the lack of cave-in protection from a trench which resulted in a trench collapse injuring an employee. b.) On or about May 13, 2024, at or near a residential home located at 549 Caroline Ave. Hubbard, OH, 44425 a competent person was on site and did not identify hazards associated with the lack of cave-in protection, spoils piles placed near the edge of the trenches, and no safe means of egress from the trenches; and failed to remove exposed employees working within the trenches to install a water line, exposing employees to caught-in hazards.
