29 CFR 1910.145(f)(3):Tags were not used as a means to prevent accidental injury or illness to employees who were exposed to hazardous or potentially hazardous conditions, equipment or operations which were out of the ordinary, unexpected or not readily A.) Andy's Equipment Exchange, Inc., Freight Elevator, On 5/14/24, and times prior thereto: The Elevator got stuck and would not level out on level four when the operator attempted to park the elevator. The elevator was left on level four until service technicians could arrive to address the issues with the elevator. The elevator was not tagged or posted with signs to alert employees to alert employees there was a problem with the elevator and that it must not be used. In addition, there was no formal communication to employees to notify employees that the elevator was out of service. On 5/14/24, an employee fell from level three to level one suffering fatal injuries. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.
