29 CFR 1926.1153(d)(2)(i):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section: Location: 8200 JFK Boulevard. North Bergen, New Jersey 07047. a) The employer did not assess the exposure of each employee performing concrete grinding activities who may be exposed to respirable crystalline silica at or above the action level. On May 14, 2024, an employee conducting grinding activities outdoors was exposed to 51 micrograms per cubic meter, which exceeds the action level (AL) of 25 �g/m3 by 2.04 times. The employer was sampled for 155 minutes. Zero exposure is assumed for the remaining 325 minutes. Violation occurred on or around May 14, 2024.
