Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about November 24, 1992, at the Hurley motor pool, an employee was injured while removing waste gasoline from a military 5,000 gallon flammable liquid transport tanker while using a vacuum pump mounted on an international Chassis. The vacuum pump was not designed to pump class 1 flammable liquids. Among other methods, one feasible and acceptable abatement method to correct this hazard is for the employer either to use a pump which is approved for handling class 1 flammable
