29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): a) Strong Brews - 5000 Township Line Road, Bethlehem, PA - Brew Tank Area - On or about April 8, 2024, and at times prior, employees were required to transfer 93% sulfuric acid from 55 gallon drums using 5 gallon open top buckets to 2500 gallon brew tanks, and the employer did not perform a workplace hazard assessment to determine all the necessary personal protective equipment when performing this job to protect the employee's lower legs from exposure to acid vapors/liquids, as required by this section. b) Strong Brews - 5000 Township Line Road, Bethlehem, PA - Brew Tank Area - On or about May 16, 2024, an employee suffered a lost time accident from a chemical burn while taking a partial of potassium hydroxide flake. The employer did not perform a workplace hazard assessment to determine all the necessary personal protective equipment when performing this job to protect the employee's exposed skin from chemical burns, as required by this section. ABATEMENT NOTE: The employer should verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated, the person certifying that the evaluation has been performed, the date(s) of the hazard assessment, and, which identifies the document as a certification of hazard assessment. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.
