29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions. At a worksite located at or near 39.185939, -93.868953 in Lexington, MO: Employees were exposed to both physical and health hazards in the performance of their job duties. The employer failed to require wearing of appropriate personal protective equipment (PPE) in all operations where there is an exposure to hazardous conditions that could cause illness or injury. This was last demonstrated on or about March 11, 2024, when employees were working to replace a sanitary sewer pipe inside a vault and employees were not required to wear PPE for potential hazards that were present or could be present during their work. This included, but was not limited to electrical, noise, toxic vapors or gases, chemical, and biological agents.
