29 CFR 1910.178(n)(6): Industrial truck drivers were not required to look in the direction of, and keep a clear view of the path of travel: On or about March 5, 2024, the employer failed to ensure forklift operators traveled in an obstruction free manner. The forklift operator at the Bobcat Farm, located in Benedict, NE operated a Moffitt M4 36.3 to deliver baby chickens to barn number twelve. While operating the Moffitt M4 36.3, the operator was unable to look in the complete direction of travel, because the load of 96-crates, approximately 7-feet in length, and 6-feet high, was obstructing the operator's view. This condition resulted in fatal injuries of an employee when he was struck-by and driven over by the Moffitt M4 36.3.
