29 CFR 1910.134(c)(2)(ii):The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (a) Recreational Equipment Inc. 303 Lafayette Street New York, NY 10012- Bike/Ski Shop Employees are required to use P-text and metal grip to conduct bike and ski repairs. The employer provided Honeywell 7700-30L (P/N 7700-11L) (Size Large), and 3M Half Facepiece Series 6200 (Size medium) tight fitting respirators for voluntary use. The employer did not provide medical evaluations by a physician or licensed health care professional (PLHCP) to qualify employees to wear respirators. Condition observed on or about February 16, 2024 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19
