29 CFR 1910.95(g)(1): The employer shall establish and maintain an audiometric testing program as provided in this paragraph by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels. On or about February 2, 2024, the employer did not implement an effective audiometric testing program for employees working on or near operations that would likely expose employees to occupational noise including but not limited to the vibrating tables, the automatic line, saws such as the Kobalt KWS S102-06, and mixing operations during their 8-hour shifts.
