29 CFR 1910.134(d)(1)(iii): The employer shall identify and evaluate the respiratory hazard(s) in the workplace; this evaluation shall include a reasonable estimate of employee exposures to respiratory hazard(s) and an identification of the contaminant's chemical state and physical form. Where the employer cannot identify or reasonably estimate the employee exposure, the employer shall consider the atmosphere to be IDLH: On or about December 28, 2023, at a facility located at 307 Forest Avenue in Sheboygan Falls, WI; the employer did not evaluate respiratory hazards in the workplace when employees were required to wear respirators while working with chemicals such as, but not limited to formaldehyde and sulfuric acid. The employer did not determine a reasonable estimate of employees' exposures to during formaldehyde transfers and LQA chemical mixing (containing in part, sulfuric acid).
