29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a. Mingo's Construction LLC, located at 860 Jaeger Street, Columbus, OH 43206: On or about October 4, 2023, during the construction of a mixed-use (commercial/residential) building, employees were engaged in the rigging of building materials such as OSB sheathing, signaling for a tower crane operator and staging the materials throughout the site. The employer did not ensure employees were instructed in the recognition and avoidance of unsafe conditions during crane/material handling operations such as but not limited to using hosing routes which minimized exposure to loads, riggers being qualified, rigging materials being inspected prior to use and loads being rigged to prevent unintentional displacement of a load. The following condition exposed employees/sub-contractor employees to struck-by hazards from the load being lifted and a subsequent felled load event.
