29 CFR 1910.28(b)(3)(i): The employer did not ensure that each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D): a) Team CCI HVAC LLC dba Fry Heating & Cooling, on or about August 28, 2023 at the address of 2045 W. Sylvania Ave. Toledo OH 43613: The employer did not ensure that employee(s) performing HVAC unit servicing atop a commercial structure were adequately protected from falling through multiple translucent corrugated fiberglass skylights measuring 3' X 8' on a low slope roof. Employee(s) performing these work activities without the benefit of an effective form of fall protection, such as personal fall arrests systems, covers or guard railing were exposed to falls of between 12ft - 15ft - 6" onto the concrete floor below.
