29 CFR 1926.651(k)(2):Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. On or about August 24, 2023, and at other times thereafter, during a sewer line replacement at a worksite located near 270 N Main Street, Chagrin Falls, OH 44022, the employer did not remove an exposed employee from the hazardous area after indications of the failure of a protective system was identified by a "competent" person.
