29 CFR 1926.55(b): To achieve compliance with paragraph (a) of this section, administrative or engineering controls must first be implemented whenever feasible. When such controls are not feasible to achieve full compliance, protective equipment or other protective measures shall be used to keep the exposure of employees to air contaminants within the limits prescribed in this section. Any equipment and technical measures used for this purpose must first be approved for each particular use by a competent industrial hygienist or other technically qualified person. Whenever respirators are used, their use shall comply with �1926.103. On or about July 20, 2023, at the worksite located at N5059 WI-107, Irma, Wisconsin; this exposure was determined by Carboxyhemoglobin calculations over 480 minutes. An employee operating a Stihl gas-powered concrete saw (Model TS420-Z, Serial No. 4238 011 2821) in the "Flume" was exposed to Carbon Monoxide at a level of 225.4 ppm as an 8-hour Time Weighted Average, approximately 4.51 times the OSHA PEL of 50 ppm. The employer failed to implement effective engineering and/or administrative controls to protect workers from the hazards associated with Carbon Monoxide overexposure. Applicable engineering or administrative controls may include but are not limited to the following: 1. Implement the use of equipment that does not generate Carbon Monoxide. 2. Provide workspaces with ventilation capable of controlling exhaust from gas powered equipment. 3. Provide employees with gas monitoring equipment to identify when atmospheres in their workspace are hazardous.
