29 CFR 1910.28(b)(15): Except as provided elsewhere in this section or by other subparts of this part, the employer must ensure each employee on a walking-working surface 4 feet (1.2 m) or more above a lower level is protected from falling by guardrail systems, safety net system, or personal fall arrest systems: a) This violation occurred on or about May 17, 2023, at a workplace located at 1645 Chapman Street, Cedar Hill, TX; where employees, who were working from the attic of a residence home, were not protected from falling through ceiling of approximately 10 feet to the ground below. The A#1 Air, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.28(b)(15), which was contained in OSHA inspection number 1561900, citation number 1, item number 1 and was affirmed as a final order on May 18, 2022, with respect to a workplace located at 4010 Fairfield Place, Frisco, TX.
