29 CFR 1926.1153(e)(2): Where respirator use is required by this section, the employer did not institute a respiratory protection program in accordance with 29 CFR 1910.134: (a)Valley Construction of Sioux Falls, Inc. at 2800 South Faith Avenue, Sioux Falls, SD 57103: On or about and at times prior to May 22, 2023, the employer did not ensure employees were protected from respirable crystalline silica hazards in that no respiratory protection program was implemented when respirators were required. This condition exposed employees to respiratory hazards/injuries/illnesses.
