29 CFR 1926.1101(k)(2)(ii): Building and/or facility owners shall notify the following persons of the presence, location and quantity of ACM or PACM, at the work sites in their buildings and facilities. Notification either shall be in writing, or shall consist of a personal communication between the owner and the person to whom notification must be given or their authorized representatives: a) On or about February 9, 2023, Fifth Third Bank failed to notify ServePro about the presence of asbestos in the second floor tiles at their branch located at 3959 N. Lincoln Avenue, Chicago IL. b) On or about March 21,2023, Fifth Third Bank failed to notify American Building Resources about the presence of asbestos in the second floor tiles at their branch located at 3959 N. Lincoln Avenue, Chicago IL. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
