29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: a. Tanger Outlets Hershey - On or about February 16, 2023, employees were exposed to a caught in hazard while working a trench installing a doghouse manhole, there was shielding however that did not provide complete protection for employees, the competent person on site did not identify the need to address the hazard or reevaluate the working conditions after the addition of concrete into the trench or when it began to rain softening the soil. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
