29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about 11/15/2022, the employer did not ensure the inspections were conducted by a competent person who has the knowledge to identify hazards associated with working in an excavation. Employees were exposed to cave-in hazards when working in an unprotected excavation approximately ten (10) feet in depth, approximately fifteen (15) feet wide, approximately fifteen (15) feet in length, and comprised of material consistent with that of previously disturbed, backfill Type B soil.
