29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) Throughout Establishment, Pool Storage Area and Maintenance Department: On or about August 2, 2022, employees were provided and wore a half-face elastomeric respirator, for voluntary use, when performing work such as, but not limited to sanding materials and adding pool chemical and the employer did not provide a medical evaluation prior to their use.
