29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s) a. Shop and Laydown Areas: On or about June 3, 2022, and times prior, the employer exposed employees to struck-by hazards, in that the employer did not remove from service the "Clark" model 660L forklift (serial number P232L-0243-9900MP) which had poorly functioning/faulty brakes and an inoperable horn where the forklift was used by employees to move heavy machinery.
