29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a)Big Al's Contracting LLC at Main Street & Washington Avenue, Salem, SD 57058: On or about and at times prior to November 22, 2021, the exposing employer did not ensure employees were instructed in the recognition and avoidance of unsafe conditions related to working in excavations without a protective system. Employees were involved in box inlet installation within trench excavations. The employer did not instruct employees in effectively evaluating the hazards related to working in excavations and protective systems regarding sloping, benching or trench boxes to ensure employees were protected within excavations deeper than five feet. These conditions exposed employees to cave-in hazards as a result of working in an excavation with vertical unsupported walls over five feet. Big Al's Contracting LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.21(b)(2), which was contained in OSHA inspection number 1422106, citation number 1, item number 1b, and was affirmed as a final order on November 7, 2019, with respect to a workplace located at South Elm Street, Central Basin 2 Project, Lennox, SD 57039.
