29 CFR 1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a)H & W Contracting, L.L.C. at Main Street & Washington Avenue, Salem, SD 57058: On or about and at times prior to November 22, 2021 the employer did not ensure that competent person inspections were conducted to identify evidence of a situations that could have resulted in possible cave-ins of the excavations in that five excavations were identified on the site to have inadequate protective systems or no protective systems installed. This condition exposed employees to cave-in hazards associated with trench wall cave-in.
