29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): a. On or about October 10, 2021, employees were operating forklifts to lift/ move, palletized loads to/ from industrial steel shelving, during which time, the employer failed to ensure that the truck which was not fitted with an overhead guard and/ or a load backrest was removed from service; therefore exposing the operator to a struck-by hazard.
