29 CFR 1910.28(b)(3)(ii):29 CFR 1910.28(b)(3)(ii): The employer did not ensure that each employee be protected from tripping into or stepping into or through any hole that is less than 4 feet (1.2 m) above a lower level by covers or guardrail systems: On or about May 19, 2021, the employer failed to ensure that all floor openings were protected to prevent employees from stepping/falling through them. About or around Dock 4, while unloading an "Ocean Container" an employee stepped into a floor opening between the ocean container and the dock. The employee broke their ankle and later formed PE blood clots that caused the employee's death.
