29 CFR 1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer did not institute a training program and ensure employee participation in the program: On or about June 2, 2021, the employer had not provided training to employees exposed to a 8 hour time weighted average of 85 decibels. A). On June 2, 2021, the sand blaster operator was exposed to continuous noise levels at 250% of the action level (8-hour, time-weighted average sound level of 85 dbA or equivalently, a dose of 50 percent), during the 437 minute sampling period. Exposure calculations include a zero increment for the 43 minutes not sampled. B). On June 2, 2021, the cut-off saw operator was exposed to continuous noise levels at 150.1% of the action level (8-hour, time-weighted average sound level of 85 dbA or equivalently, a dose of 50 percent), during the 439 minute sampling period. Exposure calculations include a zero increment for the 41 minutes not sampled.
