29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary: (a) On or about April 6, 2021, for the employees installing sanitary sewer in an trench where the spoil pile consisted of loose rocks, concrete chucks, and asphalt chunks, above the employee work area where the excavator was driving across the top of the spoil pile, in the vicinity of 500 Old Red Trail in Mandan, North Dakota.
