29 CFR 1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) On March 31, 2021: Two foreman trained as "competent persons" were directing workers installing water line in an excavation at a depth ranging from 8.0 to 10.0 feet. Employees were working outside the protection of the trench shield and at the bottom of the trench, which was 3 feet 8 inches below the trench shield. Competent persons observed this work extending below the bottom of the shield but did not take corrective actions.
