29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Bucktail Medical Center - The employer did not provide a medical evaluation to determine each employee's ability to use a Halyard, Fluidshield +3 N95 Particulate Filter Respirator/Surgical Mask and ProGear N95 Particulate Filter Respirator/Surgical Mask before requiring their use. The employer required employees to wear respirators while providing care to suspect and confirmed positive COVID-19 patients and residents on or about December 24, 2020.
