29 CFR l 910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) McKinley Health Care Center located at 800 Market Avenue North. Canton, OH 44702: On or about February 1, 2021 and thereafter, the employer did not provide a medical evaluation to determine each employee's ability to use an N95 respirator before requiring the use. The employer required employees to wear N95 respirators while providing care to suspected and confirmed positive COVID-19 residents.
