29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Eger Health Care and Rehabilitation Center, 140 Meisner Ave, Staten Island, NY On or about December 1, 2020 and thereafter, the employer did not provide a medical evaluation to determine each employee's ability to use N95 respirators before requiring the use. The employer required employees including, but not limited to Registered Nurses, Licensed Practical Nurses, and Certified Nursing Assistants, to wear respirators while providing care and services to suspected and confirmed positive COVID-19 residents. b) Eger Health Care and Rehabilitation Center, 140 Meisner Ave, Staten Island, NY On or about December 1, 2020 and thereafter, the employer did not provide a medical evaluation to determine each employee's ability to use KN95 respirators with elastic ear loops before requiring the use. The employer required employees including, but not limited to Physical Therapists, Physical Therapy Assistant, Occupational Therapist, Certified Occupational Therapy Assistant, and Housekeepers, to wear respirators while providing care and services to suspected and confirmed positive COVID-19 residents. Abatement certification and documentation is required.
