29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator or annually refitted: a) Heritage Operating Associates, LLC dba The Grand Rehabilitation and Nursing at Utica located at 1657 Sunset Ave., Utica, NY 13502, on or about January 23, 2021 and thereafter: The employer did not provide a fit test to all employees required to wear N95 filtering facepiece respirators who performed direct patient care for suspect or confirmed Covid-19 patients. The employer required healthcare professionals, including but not limited to: Licensed Practical Nurses, Registered Nurses, Certified Nurses Assistants, Activities and Rehabilitation employees to wear N95 respirators while providing direct care to suspected and confirmed positive COVID-19 residents.
