29 CFR 1926.652(c)(2)(i): Design of support systems, shield systems, or other protective systems that are drawn from manufacturer's tabulated data were not in accordance with all specifications, recommendations, and limitations issued or made by the manufacturer: (a) Fairwind Properties LLC at 10781 Arapahoe Rd, Erie, CO: On and around January 15, 2021, the exposing, creating, and correcting employer deviated from the specifications, recommendations, and limitations issued or made by the manufacturer of the shield system in that end plates were not installed on the open ends of two stacked eight feet high two-sided cave-in shield systems and in that an approximate 2.5 foot section of earth wall at the top of the excavation was not shielded because the employer had not obtained a third shield system to stack on the two stacked eight feet high two-sided cave-in shield systems. The excavation was measured at a maximum depth of approximately 20.5 feet. One of the open sides of the shield systems was facing an undercut earth wall adjacent to the vehicular traffic. These conditions exposed the employees to cave-in hazards from open sides of the shield systems and unshielded earth wall at the top of the excavation above the shield systems. (b) Fairwind Properties LLC at 10781 Arapahoe Rd, Erie, CO: On and around January 15, 2021, the exposing, creating, and correcting employer deviated from the specifications, recommendations, and limitations issued or made by the manufacturer of the shield system in that end plates were not installed in the open ends of two stacked eight feet high two-sided cave-in shield systems with a four feet high two-sided cave-in shield system on top. The excavation was measured at a maximum depth of approximately 20.5 feet. One of the open sides of the shield systems was facing an undercut excavation wall adjacent to the vehicular traffic. These conditions exposed the employees to cave-in hazards from open sides of the shield systems.
