29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) North Hill Needham located at 865 Central Avenues Needham, Massachusetts On or about January 12, 2021, the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use. The employer required employees to wear N95 respirators while providing care to suspected and confirmed positive COVID-19 residents and when conducting nasopharyngeal COVID-19 testing.
